On Thursday April 6 2017 Fox News announced that Senior Judicial Analyst Judge Andrew Napolitano would be “taking a leave of absence” from the network effective immediately. The announcement came one day after Napolitano made the stunning claim on-air that President Barack Obama had used British intelligence services to conduct surveillance on then-candidate Donald Trump during the 2016 presidential election.

While Napolitano’s claim was quickly debunked by both the British government and Fox News itself the damage was already done. Napolitano had made a serious allegation against a former president on national television without any evidence to back it up.

Fox News was put in a difficult position. On the one hand Napolitano is one of the network’s most popular and respected personalities. On the other hand his unproven claim about Obama was embarrassing for the network and made it look like a mouthpiece for Trump’s conspiracies.
